Split decision deals blow to Trump administration\u2019s anti-diversity agenda, calling the ban \u2018arbitrary, and based on animus\u2019<\/p>\n\n\n\n

Transgender troops can remain in the US military, but the armed services can continue to\u00a0block<\/a>\u00a0their enlistment, an appeals court ruled on Monday in a split decision with potentially significant consequences for the Trump administration\u2019s anti-diversity agenda.<\/p>\n\n\n\n

The divided, majority opinion<\/a> by a three-judge panel of the US court of appeals for Washington DC is expected to be challenged by the government. And the case is ultimately likely to reach the US supreme court.<\/p>\n\n\n\n

The ruling was held from going into immediate effect, allowing the administration time to ask the full appeals court to hear the case.<\/p>\n\n\n\n

But it represents a blunt rebuke of the US defense secretary Pete Hegseth\u2019s implementation of Donald Trump\u2019s January 2025 presidential order mandating the\u00a0removal of hundreds<\/a>\u00a0of transgender service members.

Such banning of transgender people from the military is illegal and \u201cboth arbitrary, and based on animus\u201d, Robert Wilkins, a circuit judge, wrote in the majority opinion.<\/p>\n\n\n\n

Monday\u2019s decision mostly upholds a preliminary injunction<\/a> issued by Ana Reyes, a district court judge, in March 2025 preventing the dismissal of six active-duty transgender people who are the plaintiffs in the lawsuit.<\/p>\n\n\n\n

At the time, Reyes wrote: \u201cThe court knows that this opinion will lead to heated public debate and appeals. In a healthy democracy, both are positive outcomes.<\/p>\n\n\n\n

\u201cWe should all agree, however, that every person who has answered the call to serve deserves our gratitude and respect.\u201d<\/p>\n\n\n\n

Hegseth indicated in a\u00a0social media post<\/a>\u00a0that the Trump administration intends to appeal the decision. \u201cSee you at SCOTUS,\u201d the post read in response to a Fox News reporter posting about the ruling.

Trump\u2019s order had claimed the sexual identity of transgender service members \u201cconflicts with a soldier\u2019s commitment to an honorable, truthful, and disciplined lifestyle, even in one\u2019s personal life\u201d. The order also argued that transgender service members\u2019 sexual identity was harmful to military readiness.<\/p>\n\n\n\n

Hegseth subsequently issued a policy presumptively disqualifying people with gender dysphoria, a medical condition arising from a person\u2019s distress related to feelings about their gender identity, from military service.<\/p>\n\n\n\n

The appeals court judges on Monday were ruling on the government\u2019s appeal of Reyes\u2019s injunction. They decided to narrow its scope to the estimated 1,000 members of the military who openly identify as trans \u2013 but not those who are seeking to join.<\/p>\n\n\n\n

\u201cIn this litigation, the government has not attempted to defend or provide any factual basis for these disparaging characterizations of American citizens,\u201d Wilkins wrote, adding that the policy \u201cappears to be driven by the bare desire to harm a politically unpopular group: persons who identify as transgender\u201d.<\/p>\n\n\n\n

Wilkins was appointed to the appeals court by Barack Obama, a former Democratic president.

The dissenting judge, Justin Walker, appointed by Trump during the Republican\u2019s first presidency, argued that the judiciary did not have the necessary authority or experience to determine who could be excluded from the military.<\/p>\n\n\n\n

He wrote that only the executive and legislative branches of the federal government \u201care responsible for system-wide military judgments about the composition of the armed forces\u201d.<\/p>\n\n\n\n

\u201cThe supreme court has never assumed that role for itself,\u201d Walker added. \u201cNeither has the DC Circuit. Not until today.\u201d<\/p>\n\n\n\n

There was no immediate reaction to the ruling from the White House or defense department.
