A group of five small businesses sued President\u00a0Donald Trump<\/a>\u00a0on Monday, seeking to block new\u00a0tariffs<\/a>\u00a0he has imposed on\u00a0foreign imports<\/a>\u00a0in recent weeks.<\/p>\n\n\n\n

\"\"<\/figure>\n\n\n\n

The lawsuit in the U.S. Court of International Trade<\/a> alleges that Trump has illegally usurped Congress\u2019 power to levy tariffs by claiming that trade deficits with other countries<\/a> constitute an emergency.<\/p>\n\n\n\n

\u201cCongress has not delegated any such power,\u201d the suit says. \u201cThe statute the President
invokes \u2014 the International Emergency Economic Powers Act<\/a> (\u2018IEEPA\u2019) \u2014 does not authorize the President to unilaterally issue across-the-board worldwide tariffs.\u201d<\/p>\n\n\n\n

The Liberty Justice Center<\/a>, which is representing the owner-operated companies, said Trump\u2019s new tariffs of at least 10% on imports<\/a> from most countries and higher rates for scores of other nations are devastating small businesses across the country.<\/p>\n\n\n\n

\u201cHis claimed emergency is a figment of his own imagination: trade deficits, which have persisted for decades without causing economic harm, are not an emergency,\u201d the suit says.<\/p>\n\n\n\n

\u201cNor do these trade deficits constitute an \u2018unusual and extraordinary threat.\u2019\u201d<\/p>\n\n\n\n

The Liberty Justice Center noted that the Trump administration imposed tariffs even on countries with which the United States does not have a trade deficit, \u201cfurther undermining the administration\u2019s justification.\u201d<\/p>\n\n\n\n

\u201cThis Court should declare the President\u2019s unprecedented power grab illegal, enjoin the operation of the executive actions that purport to impose these tariffs under the IEEPA and reaffirm this country\u2019s core founding principle: there shall be no taxation without representation,\u201d the suit says.

The plaintiffs include New York-based VOS Selections<\/a>, which imports and distributes small-production wines, spirits, and sakes; FishUSA<\/a> in Pennsylvania, a retail and wholesale e-commerce business making and selling sportfishing tackle and related gear; and Genova Pipe<\/a> in Utah, which makes plastic pipe, conduit, and fittings for plumbing, irrigation, drainage, and electrical applications.<\/a><\/p>\n\n\n\n

MicroKits LLC<\/a> in Virginia, which makes educational electronic kits and musical instruments, and Terry Precision Cycling<\/a>, a Vermont-based brand of women\u2019s cycling apparel, are also plaintiffs.<\/p>\n\n\n\n

\u201cTerry Cycling has already paid $25,000 in unplanned tariffs this year for goods for which Terry was the importer of record, and Terry projects that the tariffs will cost the company approximately $250,000 by the end of 2025,\u201d the suit says.<\/p>\n\n\n\n

Terry Cycling in 2026 expects to \u201cface an estimated $1.2 million in tariff costs \u2014 an amount that is simply not survivable for a business of its size,\u201d the suit says.<\/p>\n\n\n\n

CNBC has requested comment from the White House on the lawsuit.
