{"id":3750,"date":"2023-12-01T00:17:19","date_gmt":"2023-12-01T08:17:19","guid":{"rendered":"https:\/\/abovecloud.xyz\/?p=3750"},"modified":"2023-12-01T00:17:21","modified_gmt":"2023-12-01T08:17:21","slug":"u-s-judge-blocks-montanas-ban-of-tiktok","status":"publish","type":"post","link":"https:\/\/abovecloud.xyz\/?p=3750","title":{"rendered":"U.S. judge blocks Montana&#8217;s ban of TikTok"},"content":{"rendered":"\n<p>A Montana judge ruled on Thursday to block the state&#8217;s ban on TikTok from going into effect, marking a win for the popular video streaming app.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"960\" height=\"640\" src=\"https:\/\/abovecloud.xyz\/wp-content\/uploads\/2023\/12\/\u56fe\u7247.png\" alt=\"\" class=\"wp-image-3751\" srcset=\"https:\/\/abovecloud.xyz\/wp-content\/uploads\/2023\/12\/\u56fe\u7247.png 960w, https:\/\/abovecloud.xyz\/wp-content\/uploads\/2023\/12\/\u56fe\u7247-300x200.png 300w, https:\/\/abovecloud.xyz\/wp-content\/uploads\/2023\/12\/\u56fe\u7247-768x512.png 768w\" sizes=\"auto, (max-width: 960px) 100vw, 960px\" \/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>U.S. District Judge Donald Molloy, who heard lawsuits filed by TikTok and five Montana content creators against the state&#8217;s ban last month, said in a preliminary injunction that the move &#8220;is necessary&#8221; because the ban likely violates &#8220;their First Amendment, Supremacy Clause, and Commerce Clause claims.&#8221;<\/p>\n\n\n\n<p>In a 48-page document released by the court, the judge agreed that the law could not take effect from Jan. 1, 2024, as it was scheduled until a final determination was made.<\/p>\n\n\n\n<p>According to the 77-year-old judge, the order was made based on the three claims put forth by the plaintiffs, which alleged the Montana ban violates the company&#8217;s constitutionally protected rights to disseminate and promote third-party speech.<\/p>\n\n\n\n<p>The plaintiffs also claimed the ban is preempted by federal law as national security is a matter controlled by the federal government.<\/p>\n\n\n\n<p>They also said the ban violates the Commerce Clause in the U.S. Constitution which bans state laws that unduly burden interstate and foreign commerce.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Montana judge ruled on Thursday to block the state&#038;#8 [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":3751,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[5,12],"tags":[1823,1822,1745],"class_list":["post-3750","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-sino-american","category-usa","tag-blocks","tag-judge","tag-montana"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v19.0 -
